CUIAB Board of Review: Cindy Montanez and Fred Aguiar

Statement of Facts: When the claimant did not appear for a duly scheduled hearing, decisions were issued which dismissed the appeal. Within the period provided by California Code of Regulations, title 22, section 5067, the clamant in writing appealed the decision dismissal. A second hearing was held at which the claimant’s mother appeared and presented reasons for the claimant not appearing at the first hearing. After consideration of the claimant’s reasons, orders were issued holding that good cause had not been shown for failure to appear at the hearing and therefore the matter would not be reopened. From such orders, the claimant has appealedHaving given careful consideration of the claimant’s reasons for not appearing at the hearing, we conclude that they are not sufficient to constitute good cause for reopening the matter. Accordingly, the application to reopen the appeal is denied.
